Terms of service

AgileSales AI is provided by SAM CLOUD, CA, based in Barquisimeto, Lara, Venezuela. By creating an account or using the service, the person doing so, on behalf of their business, accepts these terms and the privacy policy.

A monthly service for a business to serve its customers on WhatsApp, Instagram and Facebook with artificial intelligence agents. The agent checks the price and stock the business loads, prepares the order as a draft and waits for a person at the business to confirm it.

If the business has SAP Business One, the confirmed order can be sent afterwards. If not, the business loads its data from files.

The business chooses who represents it in the panel, as Administrator or Operator, and is responsible for what they do with its account. Credentials are personal and must not be shared.

You must give us true information when you sign up and keep it up to date.

The business agrees to:

• Write only to people who have a relationship with it or have agreed to receive its messages, and not send unsolicited bulk messages.
• Follow Meta's terms and policies for WhatsApp Business, Instagram and Facebook, including the commerce policies, and the laws that apply to it.
• Not use the service to sell prohibited products, deceive its customers, impersonate others or send unlawful content.
• Review drafts before confirming them. Only a person confirms orders and applies discounts.
• Have the right to load the data it uploads and tell its customers how it is handled.

The agent uses fixed tools inside the business and answers with what those tools return. It can make mistakes. The business must review what the agent prepares and must not treat its answers as medical, legal or financial advice.

The agent does not confirm orders or apply discounts. When a rule is missing or the case is outside its scope, it passes the conversation to a person.

The service is bought as a monthly plan, with the conditions and prices published on the plans page. Costs that Meta or other providers charge for their own services are governed by each one's terms.

You can cancel at any time; cancellation takes effect at the end of the period already paid.

We do our best to keep the service available, but it depends on providers such as Meta, Google, Supabase and Vercel. There may be interruptions, changes in the messaging platforms or limits we do not control, and we do not guarantee that the service will run without pauses or errors.

The data the business loads and its conversations with its customers belong to the business. We handle them to provide the service, as the privacy policy explains. The software, the brand and the texts of the agent templates belong to SAM CLOUD, CA.

To the extent the law allows, SAM CLOUD, CA is not liable for indirect losses, lost profits or decisions the business makes based on the agent's answers. Our total liability for a claim is limited to what the business paid for the service in the three months before it.

You can close your account at any time. We can suspend or close it if these terms are breached, if a use puts the service or other people at risk, or if a legal obligation requires it. When possible, we will warn you first.

We may change these terms; we will publish the new version with its date and tell the businesses if the change is important. Using the service after the change means accepting it.
